In-House IP Lawyer – Brazil (São Paulo)

About the role

BrandMonitor is seeking an experienced IP Lawyer to lead enforcement actions across Brazil. The role is remote‑first but requires regular presence in São Paulo for court hearings, raids, and coordination with authorities.

Key responsibilities

• Identify and monitor intellectual property infringements throughout Brazil.
• Draft and send cease‑and‑desist letters, legal claims, and negotiate settlements.
• Represent rights holders in pre‑litigation, civil litigation, and criminal IP proceedings.
• Coordinate and participate in search‑and‑seizure operations and other enforcement actions with police, customs, prosecutors, and regulatory agencies.
• Prepare powers of attorney, affidavits, criminal complaints, petitions, and other litigation documents.
• Build and maintain relationships with law‑enforcement agencies, courts, investigators, and service providers.
• Recover monetary compensation through settlements or court decisions.
• Support legal and business operations in Brazil, including contracts, compliance, office setup, banking, and corporate matters.

Required profile

• Law degree and admission to the Brazilian Bar (OAB).
• Minimum 3 years of hands‑on IP experience, either in‑house or at a law firm.
• Proven track record in IP enforcement, civil litigation, and criminal IP matters, including raids and anti‑counterfeiting investigations.
• Experience coordinating enforcement actions with public authorities.
• Excellent legal drafting, negotiation, and communication skills.
• Fluent Portuguese and professional English (written and spoken).
• Highly organized, proactive, and able to work independently.
